TERMS OF SERVICE

1. Agreement to Terms
Welcome to FixiPoint ("Platform," "Service," "we," "us," or "our"). The Platform is operated by MB "E. zona", a private limited liability company (mažoji bendrija) registered in the Republic of Lithuania, legal entity code 305028946, with its registered office in Kaunas, Lithuania ("FixiPoint").
These Terms of Service ("Terms") govern your access to and use of our platform, including our website, mobile applications, and related services.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
These Terms do not limit any mandatory rights you have as a consumer under the laws of the Republic of Lithuania or the European Union. Where any provision of these Terms conflicts with such mandatory rights, those rights prevail.
The relationship between FixiPoint and Service Providers (including subscription, fees, and provider obligations) is governed by a separate Service Provider Agreement, not by these Terms.
2. Definitions
• "Platform" or "Service" means the FixiPoint website, mobile applications, and all related services.
• "User," "you," or "your" means any person who accesses or uses the Service as a customer seeking repair services.
• "Service Provider" means a business, technician, or professional that offers repair services and uses the Platform to manage its repair operations.
• "Consumer" means a User who acts for purposes outside their trade, business, craft, or profession.
• "Booking" or "repair case" means a reservation or request for repair services made through the Platform.
• "Connected Payment Integration" means a payment-collection method (such as a payment service provider account or gateway) that a Service Provider connects to, or activates within, the Platform under its own name and account, through which the Service Provider collects payments directly from its customers.
• "Shipping Service" means the optional delivery service offered through the Platform for sending an item to a Service Provider for repair and returning it.
• "Content" means text, images, photos, videos, data, and other materials posted, uploaded, or transmitted through the Service.
• "Account" means your registered account on the Platform.
3. Eligibility
3.1 Age Requirement
You must be at least 18 years old to register an Account and enter into these Terms. A person aged 14 or older but under 18 may use the Service only with the involvement and consent of a parent or legal guardian, who accepts these Terms on their behalf. (Under Lithuanian law, 14 is the minimum age at which a child may consent to information-society services on their own behalf in the limited cases permitted by law; full contractual capacity requires guardian involvement below 18.)
3.2 Legal Capacity
By using the Service, you represent that you have the legal capacity to enter into a binding contract.
3.3 Geographic Availability
The Service may not be available in all geographic locations. We reserve the right to restrict access based on location.
4. Account Registration
4.1 Account Creation
To use certain features of the Service, you must create an Account by providing:
• Your name
• Email address
• Phone number
• Password
• Other information as required
4.2 Account Accuracy
You agree to:
• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
4.3 Account Responsibility
You are responsible for:
• All activities under your Account
• Maintaining the confidentiality of your login credentials
• Any charges or damages incurred through your Account
4.4 One Account Per Person
You may only maintain one active Account. Creating multiple accounts may result in suspension or termination of all accounts.
5. Use of the Service
5.1 License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
5.2 Permitted Use
You may use the Service to:
• Browse and search for Service Providers
• Book repair services
• Communicate with Service Providers
• Track your bookings and repairs
• Arrange Shipping Services where offered
• Leave reviews and feedback
• Manage your Account
5.3 Prohibited Activities
You agree NOT to:
• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Use automated tools (bots, scrapers) without permission
• Harass, abuse, or harm others
• Post false, misleading, or fraudulent content
• Impersonate others or misrepresent your affiliation
• Interfere with the proper functioning of the Service
• Collect user information without consent
• Circumvent security measures
• Submit fake or fraudulent bookings
5.4 Service Provider Independence
Service Providers are independent businesses, not employees or agents of FixiPoint. We do not employ or control Service Providers, nor do we perform repair services ourselves.
6. Bookings and Services
6.1 Booking Process
When you book a service:
• You enter into a direct agreement with the Service Provider
• You agree to the Service Provider's terms and pricing
• You authorize us to transmit your booking to the Service Provider
• Any deposit or payment for the repair is owed to, and collected by, the Service Provider — not by FixiPoint (see Section 7)
6.2 Platform Role
We provide software tools that connect customers with Service Providers and help Service Providers manage their repair operations. We:
• Do not provide repair services directly
• Do not guarantee service quality or outcomes
• Are not responsible for Service Provider actions or performance
• Do not control Service Provider schedules, pricing, or availability
6.3 Service Provider Selection
You are responsible for:
• Selecting appropriate Service Providers
• Reading reviews and ratings
• Communicating your service requirements clearly
6.4 Booking Modifications
• Modification and cancellation policies are set by individual Service Providers
• Changes may be subject to fees charged by the Service Provider
• We facilitate communication but do not control Service Provider policies
6.5 No-Shows and Cancellations
If you fail to appear for a scheduled booking without proper notice:
• The Service Provider may charge a cancellation or no-show fee in accordance with its own policy and applicable consumer law
• Your ability to book future services may be restricted
• Service Providers may decline future bookings from you
6.6 Trader Identity
Where required by law, before a Service Provider can offer services to Consumers through the Platform, we collect and, where applicable, verify identifying information about that Service Provider (such as name, contact details, and registration or identification numbers), in accordance with the EU Digital Services Act. This helps ensure Service Providers are identifiable to Users and competent authorities.
7. Payments
7.1 Repair Payments Go Directly to the Service Provider
Payment for repair services is made directly to the Service Provider. When you pay for a repair, the funds reach the Service Provider's own account through that Service Provider's individually Connected Payment Integration.
FixiPoint does not act as an intermediary, agent, or payment processor between you and the Service Provider with respect to repair-service payments. FixiPoint does not hold, receive, collect, or have control over repair-service funds, and does not set repair prices.
7.2 Payment Methods for Repairs
The available methods for paying a Service Provider depend on what that Service Provider offers, which may include:
• The Service Provider's Connected Payment Integration; or
• If the Service Provider has not connected its own integration, other payment-collection platforms it chooses to activate; or
• Standard bank transfer; or
• Payment in person — at the service location or point of sale.
In all of the above cases, FixiPoint takes no part in the settlement process between the Service Provider and its customer.
7.3 Refunds, Chargebacks, and Disputes for Repairs
Because repair-service funds never pass through FixiPoint:
• Refunds for repair services are issued by the Service Provider, in accordance with the Service Provider's policy and applicable consumer law
• FixiPoint cannot issue, reverse, or facilitate repair-service refunds or chargebacks
• Any dispute regarding a repair payment must be resolved directly between you and the Service Provider, and where applicable through the payment provider used by that Service Provider
7.4 Shipping Payments — The Only Payments FixiPoint Collects
The Service offers an optional Shipping Service so that you can send an item to a Service Provider for repair. Where you choose this option:
• The shipping fee is paid through FixiPoint's own payment integration, directly to FixiPoint
• The item is then delivered to the Service Provider you selected for repair, and returned where applicable
• This shipping fee is the only payment in which FixiPoint is a party
Shipping fees are disclosed before you confirm the Shipping Service. FixiPoint's responsibility under the Shipping Service is limited to arranging delivery; the actual carriage is performed by third-party carriers subject to their own terms, and liability for loss or damage in transit is governed by those terms and applicable law. Refund terms for the Shipping Service are set out in Section 7.7.
7.5 Platform / Subscription Fees
Fees charged by FixiPoint to Service Providers for use of the Platform are governed by the separate Service Provider Agreement and are not part of these Terms. They are separate from repair payments and shipping fees.
7.6 Pricing and Currency
• Repair prices are set by individual Service Providers and displayed before you confirm a booking
• Shipping fees are displayed before you confirm the Shipping Service
• Prices are shown and charged in euro (EUR) unless otherwise specified, and include applicable taxes where required by law
7.7 Shipping Service — Performance and No Refund Once Used
The Shipping Service is a service, not the sale of an item. When you order the Shipping Service, you expressly request that FixiPoint begin performing it immediately and acknowledge that, once the Shipping Service has been provided (for example, once the shipment has been collected or dispatched), the service is fully performed and the shipping fee is non-refundable.
To the extent any consumer right of withdrawal would otherwise apply to this service, you acknowledge that, by requesting immediate performance, that right is lost once the service has been fully performed, in accordance with the EU Consumer Rights Directive and the Lithuanian Civil Code.
If you cancel before the Shipping Service has been provided, applicable consumer law governs any refund of the shipping fee. This Section concerns only the Shipping Service provided by FixiPoint; withdrawal rights and refunds for repair services are the responsibility of the relevant Service Provider.
8. Reviews and Ratings
8.1 Posting Reviews
You may post reviews and ratings of Service Providers if you have used their services. Reviews must:
• Be based on genuine experience
• Be honest and accurate
• Not contain offensive, defamatory, or illegal content
• Not violate others' privacy or intellectual property rights
• Not be influenced by undisclosed compensation
8.2 Our Rights
We may:
• Remove or moderate reviews that violate these Terms
• Verify that reviewers have used the service
• Display reviews on the Platform
• Use reviews in marketing materials, in compliance with applicable law
8.3 Review Verification
We take reasonable and proportionate steps to confirm that reviews come from Users who have actually used the relevant Service Provider — for example, by linking the ability to leave a review to a completed booking. We do not otherwise verify the accuracy of the opinions expressed, which represent individual experiences. We do not submit or commission fake reviews, and we do not present reviews as verified where they are not.
9. Intellectual Property
9.1 Our Intellectual Property
The Service, including all content, features, and functionality, is owned by FixiPoint and protected by copyright, trademark, trade-secret, and other intellectual property laws. This includes platform design and layout; logos, brand names, and trademarks; software and code; text, graphics, images, and videos; and compilations and arrangements.
9.2 Your License to Us
When you post Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, display, and perform that Content for the purpose of operating, promoting, and improving the Service, for the duration protected by intellectual property rights.
9.3 Your Content Responsibility
You represent and warrant that:
• You own or have rights to the Content you post
• Your Content does not infringe on others' rights
• Your Content complies with these Terms and applicable laws
9.4 Restrictions
You may not:
• Copy, modify, or create derivative works of the Service, except as permitted by mandatory law
• Reverse engineer or decompile our software, except to the extent such restriction is prohibited by law
• Remove copyright or trademark notices
• Use our trademarks without permission
• Frame or mirror any part of the Service without authorization
10. Privacy and Data Protection
10.1 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information in accordance with the EU General Data Protection Regulation (GDPR) and Lithuanian data-protection law. FixiPoint, MB "E. zona", acts as data controller for the personal data it processes for its own purposes.
10.2 Communications
By using the Service, you consent to receive transactional emails (booking confirmations, updates) and service-related notifications. Marketing communications are sent only where permitted by law, and you may opt out at any time.
10.3 Repair Case Communications
To process and manage your repair case (Booking), you agree that FixiPoint and/or the relevant Service Provider may contact you by telephone call, SMS / text message, and email in connection with that case, including to:
• Provide updates on the status of your repair
• Request additional information needed to carry out the repair
• Provide information, instructions, quotes, or estimates related to the repair
• Ask you to submit a confirmation, approval, or authorization (for example, to approve work or costs)
• Invite you to leave a review after the repair is completed
These messages relate to your specific repair case and are part of providing the Service, so they may be sent without separate marketing consent. You may opt out of review invitations and other non-essential messages at any time, using the opt-out method indicated in the message or by contacting info@fixipoint.com; opting out of these does not stop essential service messages necessary to perform your repair case. We use the contact details in your Account or those you provide for the Booking for this purpose.
10.4 Your Privacy Rights
You have rights regarding your personal data under the GDPR, including rights of access, rectification, erasure, restriction, portability, and objection. See our Privacy Policy for information about exercising these rights and about contacting the State Data Protection Inspectorate of Lithuania (Valstybinė duomenų apsaugos inspekcija).
11. Communications Between Users and Service Providers
11.1 Platform Communications
Communications between you and Service Providers should occur through the Platform where possible, to maintain service quality, help resolve disputes, and protect both parties.
11.2 Direct Contact
Once a booking is confirmed, a Service Provider may contact you directly for service-related communications.
11.3 Communication Standards
When communicating through the Platform, you must be respectful and professional, and must not use offensive, threatening, or harassing language.
12. User Conduct and Safety
12.1 Safe Conduct
You are responsible for your safety when meeting with Service Providers, providing access to your property or devices, and sharing personal information.
12.2 Reporting Issues
You should promptly report unsafe behavior, fraudulent activity, Terms violations, security concerns, or criminal activity to info@fixipoint.com.
12.3 Verification
We may carry out verification of users where appropriate, but we do not guarantee the accuracy of user information, the safety of interactions, or the quality of services.
13. Warranties and Disclaimers
13.1 Platform Provided "As Is"
To the extent permitted by law, the Platform itself is provided "as is" and "as available," without warranties that it will be uninterrupted, error-free, or free of harmful components.
13.2 Mandatory Consumer Rights Preserved
Nothing in this Section excludes or limits the statutory rights you have as a Consumer under Lithuanian or EU law, including rights relating to the conformity of services and goods and statutory guarantees. These rights are owed by the relevant Service Provider for repair services, and by FixiPoint for the Shipping Service and the Platform where applicable.
13.3 No Warranty on Service Providers
We do not warrant the quality, safety, or legality of repair services provided by Service Providers, the accuracy of Service Provider information, or that Service Providers are properly licensed or insured. Repair services are provided by, and are the responsibility of, the Service Provider.
14. Limitation of Liability
14.1 What Is Not Limited
Nothing in these Terms limits or excludes our liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Intentional misconduct or gross negligence
• Any liability that cannot be limited or excluded under mandatory Lithuanian or EU law, including mandatory consumer-protection law
14.2 Liability for FixiPoint's Own Services
For services FixiPoint provides directly (such as the Shipping Service and the Platform), FixiPoint is liable for damage caused by its failure to perform in accordance with these Terms. For Consumers, this liability covers reasonably foreseeable loss resulting from such failure and is not subject to the monetary cap in Section 14.4; nothing in these Terms limits a Consumer's mandatory statutory remedies.
14.3 Excluded Losses
Subject to Section 14.1, and to the maximum extent permitted by law, FixiPoint shall not be liable for indirect, incidental, special, or consequential damages, loss of profits, data, use, or goodwill, or for the acts, omissions, or performance of Service Providers (including the repair services they provide and the payments they collect).
14.4 Maximum Liability (Business Users)
For users acting in a business capacity, and subject to Section 14.1, FixiPoint's total aggregate liability for any claims arising from these Terms or use of the Service shall not exceed the greater of EUR 100 or the total amount paid to FixiPoint in the 12 months before the claim arose. This cap does not apply to amounts owed to Service Providers, which FixiPoint never receives.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless FixiPoint and its representatives from claims, losses, damages, liabilities, and reasonable costs arising from your use of the Service, your violation of these Terms, your violation of the rights of another party, your Content, or your interactions with Service Providers. If you are a Consumer, you are required to compensate FixiPoint only for loss caused by your own intentional or negligent breach of these Terms or of the law, and only to the extent permitted by mandatory consumer-protection law; the broader indemnity above applies to users acting in a business capacity.
16. Third-Party Services and Links
16.1 Third-Party Services
The Service may integrate with or link to third-party services (payment providers, carriers, maps, etc.). These third parties have their own terms and privacy policies, are not controlled by us, and are not endorsed or guaranteed by us.
16.2 External Links
We may provide links to external websites for convenience. We are not responsible for the content, privacy practices, or products of external sites.
17. Term and Termination
17.1 Term
These Terms remain in effect while you use the Service.
17.2 Termination by You
You may terminate your Account at any time by requesting account deletion through account settings, contacting customer support, or following our account deletion procedure.
17.3 Termination by Us
We may suspend or terminate your Account, with reasonable notice where required by law and immediately where you materially breach these Terms or where the law allows, if you violate these Terms, engage in fraudulent activity, harm other users, or create legal liability for us.
17.4 Effect of Termination
Upon termination, your right to use the Service ends, we may delete your Account and Content subject to legal retention requirements, outstanding payment obligations survive, and provisions that by their nature should survive (such as limitations of liability and dispute resolution) will continue.
17.5 Data Retention
After termination, we may retain your data as required by law or for legitimate business purposes. See our Privacy Policy for details.
18. Dispute Resolution
18.1 Informal Resolution
Before bringing a claim, please contact us at info@fixipoint.com so we can try to resolve the matter informally.
18.2 Consumers — Out-of-Court Resolution
If you are a Consumer and we cannot resolve a dispute informally, you have the right to use out-of-court dispute-resolution options. In Lithuania, the competent authority is the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba, vvtat.lt). You may also bring proceedings before the competent courts. As a Consumer, you retain the right to bring proceedings in the courts of your place of residence, and to rely on the mandatory consumer-protection provisions of the law of your country of residence.
18.3 No Mandatory Arbitration or Class-Action Waiver
We do not require you to submit consumer disputes to binding arbitration, and we do not require you to waive any right to participate in collective or representative proceedings available under applicable law.
18.4 Business Users
For users acting in a business capacity, any dispute that cannot be resolved informally shall be submitted to the competent courts of the Republic of Lithuania.
19. Governing Law
19.1 Applicable Law
These Terms are governed by the laws of the Republic of Lithuania and, where applicable, the law of the European Union. For Consumers, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence.
19.2 International Use
If you access the Service from outside Lithuania, you are responsible for compliance with applicable local laws.
20. General Provisions
20.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FixiPoint regarding your use of the Service as a customer.
20.2 Amendments
We may modify these Terms. We will notify you of material changes by email, by prominent notice on the Service, or by in-app notification, with reasonable advance notice where required by law. Changes do not apply retroactively to confirmed bookings. Your continued use after changes take effect constitutes acceptance; if you do not accept, you may stop using the Service.
20.3 Severability
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
20.4 Waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
20.5 Assignment
You may not assign or transfer these Terms without our consent. We may assign our rights and obligations where this does not reduce your rights under mandatory law.
20.6 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, labor disputes, government actions, internet or infrastructure failures, etc.).
20.7 Language
These Terms are provided in Lithuanian and may be provided in other languages. For Consumers resident in the Republic of Lithuania, the Lithuanian-language version governs. For all other users, where versions conflict, the English-language version governs, except where mandatory law requires otherwise.
20.8 No Agency
No agency, partnership, joint venture, or employment relationship is created by these Terms.
20.9 Headings
Section headings are for convenience only and do not affect interpretation.

22. Special Provisions for Specific Services
22.1 Mobile Applications
When you use our mobile applications, additional terms from app stores (Apple App Store, Google Play) may apply, we do not guarantee compatibility with all devices, and updates may be required for continued functionality.
22.2 Emergencies
The Service is not for emergencies. In case of emergency, contact local emergency services (112 in the EU) immediately.
22.3 Warranty Repairs
If you book warranty repairs, manufacturer warranties are separate from our Service, we do not guarantee warranty-claim approval, and the Service Provider determines warranty applicability.
23. Feedback and Improvements
23.1 Feedback License
If you provide feedback, suggestions, or ideas, we may use them without compensation to improve the Service, to the extent permitted by law.
23.2 Service Improvements
We continuously improve the Service and may add or remove features, change the interface, or modify pricing or policies, with notice where required by law.
24. Beta Features
We may offer beta, experimental, or preview features. These are provided "as is" with additional risks, may not work as intended, and may be discontinued without notice. Special terms may apply.
25. Accessibility
We strive to make our Service accessible to all users. If you experience accessibility issues, please contact info@fixipoint.com.
26. Minors
Our Service is not intended for children under 14. We do not knowingly collect personal data from children under 14 without the consent of a holder of parental responsibility, in accordance with the GDPR and Lithuanian law. If you believe we have collected such data, contact us immediately at info@fixipoint.com.
ACKNOWLEDGMENT
BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
